Privacy Policy

This policy relates to our use of any personal information you provide to us through Ki Performance websites, and forms part of the terms and conditions of use.

Like many other organisations, we’re keen to gather information about how visitors use our website. In general, you can visit many of our web pages without telling us who you are or revealing any personal information about yourself. Although we may track your visit for trends and statistics, you’ll remain anonymous unless you tell us who you are. Once you choose to give us your personal information, you will no longer be anonymous to us.

As we may change our privacy policy from time to time, we would encourage you to refer to it on an ongoing basis so you understand how things stand currently.

The information you give us

We receive and store any information you enter on our websites or give us in any other way. However, we don’t collect any personal information about you unless you voluntarily submit it to us. Our websites use registration for communities, as well as an order form for you to request products and services. This can include information such as your name, e-mail address, postal address, telephone or mobile number, and date of birth.

The information we collect on our websites

Our websites may use cookies and collect IP access logs (an IP address is a number that can uniquely identify a specific computer or device on the internet). We use analysis software to look at IP addresses and cookies for the purpose of enhancing your experience and improving our services.

However, we don’t use this information to develop a personal profile of you. Neither do we automatically log personal data, nor link information automatically logged by other means with personal data about specific individuals.

Children

We don’t knowingly collect personal data from children on our websites.

We take the following steps to protect the privacy of children:

• Only teenagers and adults are allowed to register for Ki Performance website communities.
• The Online Activity Manager requires a separate login and password, which is only available with the purchase of a subscription.

How about cookies?

Cookies are identifiers that we transfer to your computer through your web browser. The data we collect is anonymous and Ki Performance has no way of accessing any of your personally identifiable information through this system. For example, we use cookies to:

• Remember the items in your shopping basket
• Recognise you when you return to our website
• Analyse visitor behaviour

The "help" portion of your toolbar will tell you how to prevent your browser from accepting new cookies,  get it to notify you when you are to receive a new cookie, or disable cookies altogether. However, cookies do help some of our web pages and services to function correctly, so we recommend that you leave them turned on.

The use of your personal information

We use the information you provide to help us continually improve our services. For example, if you sign up for an email newsletter, we’ll send it to the address you provide.

Ki Performance will use your personal information for a number of purposes, including the following:

• For "service administration purposes", which means that we may contact you for reasons related to the service you have signed up for (for example, to provide you with password reminders or notify you that a particular service has been suspended for maintenance).
• To contact you about a submission you have made to the websites, including any content you provide.
• To identify the number of visits from different locations and block disruptive use.
• To analyse and improve the services offered on our websites.
• To prevent offensive, inappropriate or objectionable content or other disruptive behaviour.
• On rare occasions, we may disclose specific information when it’s requested by the government or required by law, in response to a court order, to enforce our website policies or to protect either our or others' rights, property, or safety. We may also share information with companies assisting in fraud protection or investigation. However, we don’t offer information to these agencies or companies for marketing or commercial purposes.

How about third parties?

Information about our customers is an important part of our business, and we use it responsibly. We employ or partner with other companies and individuals to perform functions on our behalf. Examples include processing credit card payments and providing marketing assistance. But while these companies have access to the personal information needed to perform their functions, they cannot use it for other purposes.

In addition, we may sell general, non-personally identifiable information about our users or join forces with third party companies, who can use personally identifiable information only if they have privacy policies in line with our own.  We will only release such information when we believe it complies with the law or protect the rights, property, or safety of Ki Performance, its users or others.

Security

We use industry-standard methods to protect your personal information from unauthorised access. Among other techniques, we usually store such information on a computer behind our "firewall" in a secure location, and often restrict the number of employees internally who can access such data.

All the credit card information you supply online is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be accessed only as stated above. But despite these efforts, we can’t guarantee that any data transmission over the Internet or computer storage is 100% secure.

Choice, access and correction of information

As discussed above, you can always choose not to provide certain information, even though providing it can help you take advantage of our features. Our site also gives you a choice of whether or not to receive communications from us and our partners. You have the following options for changing information previously provided or removing your information from our database.

• Website Community Information: To modify or delete the information you’ve provided, please login and update your profile.
• Email Communication: To unsubscribe from an email, please follow the instructions in the email you receive.

Please note that due to production schedules, if you have unsubscribed from any Ki Performance communications, you may still receive communications already in production.

Retention

We will hold your personal information on our systems for as long as is necessary for the relevant service, or as long as is set out in any relevant contract you hold with Ki Performance or our corporate retention schedule. If you decide to cancel your website registration, some personal information may remain on the system for one year for administration purposes. We may maintain data about sales transactions or service enquiries for future service and record keeping purposes.

Where you contribute to Ki Performance communities, we’ll usually only keep your content for as long as is reasonably required for the purpose(s) for which it was submitted. In some circumstances, we may keep information for a longer, or even permanent duration.

Transferring your personal information outside the European Economic Area

As part of the services we offer you through this site, your information will be transferred to countries outside the European Economic Area (EEA). We have service partners that are located in the United States of America for instance. Countries that operate outside the EEA may not have similar data protection laws to the EEA, but you can be assured that we will take appropriate action to ensure that your privacy rights continue to be respected.

If you use the Ki Performance service while you are outside the EEA, it is likely that your information will be transferred outside the EEA in order to provide you with our service.
